Manhattan ACS cases are handled out of the ACS Harlem office and if a court petition is filed, the case will be heard at Family Court at 60 Lafayette Street, in lower Manhattan. The case is typically assigned to a judge who has intake on that particular day. Do not expect ACS to give you any advance warning of any kind that they are going to file a petition against you. This is done to keep the parents off-balance and provide them with as little information as possible. ACS does not want you to have time to hire an attorney and prepare a defense.

Often parents are told over the phone that they have to be in court at 3pm and that is all of the notice that they will receive. It is crucial that you have your own attorney at the very first hearing; otherwise ACS will have a huge advantage. There are some excellent court-appointed ACS lawyers, but the reality is that their caseload is too big to give parents the attention they deserve.
